FDA Regulatory Consulting for Medical Devices

Parul Chansoria, Founder and CEO of Elexes, presenting an FDA medical device regulatory strategy message.

The process of bringing an FDA medical device to the United States market is not just about choosing the kind of submission to be used. The FDA regulation strategy takes into account the classification of the device, the intended use, claims, technology, data, testing, documentation, quality systems, and post-market requirements.

For manufacturers new to the US market, the first issue is usually clear: what is FDA asking for in this device? The answer varies according to the nature of the device, its intended use, risk profile, technology, predicates, regulatory history, and the evidence available for supporting the claims.

Elexes helps medical device companies assess these factors early, develop a practical FDA regulatory pathway, prepare the supporting documentation, and manage regulatory activities through submission and beyond.

When Do You Need FDA Regulatory Consulting?

FDA requirements can become difficult to navigate when a device does not fit neatly into an existing regulatory pathway or when several regulatory decisions are connected.

You may need regulatory support when:

⦿ You are unsure how FDA would classify your device or which product code applies.

⦿ You have several potential predicates but are uncertain which one provides an appropriate regulatory basis.

⦿ Your intended use or claims may affect the regulatory pathway.

⦿ The device incorporates software, AI/ML, cybersecurity, wireless technology, or other newer technologies.

⦿ Required performance, clinical, biocompatibility, EMC, electrical safety, human factors, or other evidence has not yet been defined.

⦿ Existing documentation was developed for another market and needs to be assessed for U.S. applicability.

⦿ FDA has raised questions during review.

⦿ A modification to a marketed device may affect its existing FDA authorization.

⦿ Your organization needs to establish or update FDA registration, listing, or related establishment information.

The objective is to identify the regulatory decisions that matter before they create rework later in development or submission preparation.

How the FDA Regulatory Pathway Is Determined

There is no one-size-fits-all FDA pathway that will work for all kinds of medical devices. There are several pathways under FDA pre-market framework based on different factors including classification, risk, novelty, predicate availability, and other device-specific factors.

Device Classification and Product Code

The starting point is understanding whether the product meets the FDA definition of a medical device and, if so, how FDA classifies it.

FDA classification is connected to the applicable regulation, medical specialty panel, and product code. The Product Classification Database is one of FDA's tools for identifying these elements.

Elexes can evaluate:

⦿ Definition and status of device

⦿ Regulation of classification

⦿ Code for product

⦿ Classification controls

⦿ Authorized FDA devices

⦿ Preliminary submission requirements

Intended Use, Indications and Claims

The intended use and proposed claims influence how FDA views a device and the evidence needed to support it.

We review the proposed intended use, indications, patient population, use environment, technological characteristics, and claims together rather than treating labeling as a final-stage exercise.

This helps identify whether the proposed claims are aligned with the intended regulatory pathway and available evidence.

Predicate and Regulatory History

For devices potentially qualifying for 510(k) marketing pathway, the choice of predicate and substantial equivalence approach are key factors. FDA defines substantial equivalence through intended use and technology based on appropriate data.

For novel devices where there is no legally marketed predicate, a De Novo request may be relevant depending on the applicability of statutory criteria.

Elexes analyses regulatory history, predicate options, technological differences, and documentation needs prior to making recommendation on the submission strategy.

FDA Premarket Pathways and Programs

The appropriate FDA approach depends on individual device and regulatory situation. In general terms, Elexes performs assessment and preparation of submission in the following premarket pathways and programs.

FDA 510(k)

The 510(k) pathway generally requires a demonstration of substantial equivalence to a legally marketed predicate, unless an applicable exemption or different pathway applies. FDA currently requires most 510(k) submissions to be submitted electronically through eSTAR, subject to applicable exemptions.

FDA De Novo

The De Novo pathway is used for certain novel, low to moderate risk medical devices that lack a predicate legally marketed in the United States and for which general controls alone, or general and special controls alone, would provide a reasonable assurance of safety and effectiveness.

FDA PMA

Premarket Approval is the FDA marketing application pathway for devices requiring PMA, including many Class III devices. It involves scientific and regulatory review of evidence supporting the device's safety and effectiveness.

Q-Submission

The Q-Submission Program provides mechanisms for obtaining FDA feedback and holding meetings related to various medical device submissions, including 510(k)s, De Novo requests, PMAs and IDEs.

Investigational Device Exemption (IDE)

An IDE can allow an investigational device to be used in a clinical study to collect safety and effectiveness data, subject to the applicable IDE requirements. Significant-risk studies require FDA and IRB approval before initiation.

Breakthrough Device Designation

The Breakthrough Devices Program is available for certain devices meeting FDA's eligibility criteria and can provide opportunities for increased interaction with FDA during development and prioritized review. A designation request is submitted through a Q-Submission.

What FDA Regulatory Documentation May Need to Address

A regulatory pathway is only one part of the submission strategy. The supporting evidence and documentation must also address the characteristics and risks of the specific device. Depending on the device and pathway, Elexes can support assessment and preparation of:

Device and Technical Documentation

⦿ Device description and technological characteristics

⦿ Specifications and engineering information

⦿ Intended use and indications

⦿ Accessories and components

⦿ Manufacturing information

⦿ Regulatory history

⦿ Applicable standards and guidance

Performance and Safety Evidence

The evidence strategy is developed according to the device and applicable FDA expectations. Depending on the product, this may include:

⦿ Bench and performance testing

⦿ Electrical safety and EMC

⦿ Biocompatibility

⦿ Sterilization and shelf life

⦿ Software verification and validation

⦿ Human factors and usability

⦿ Cybersecurity

⦿ Animal or clinical evidence where applicable

Current guidance from the FDA includes recommendations on software functions and cybersecurity documentation relevant to pre-market submissions.

FDA Quality System and Establishment Considerations

FDA regulatory strategy does not end with the premarket submission.

The Quality Management System Regulation (QMSR) became effective on February 2, 2026, amending 21 CFR Part 820 and incorporating ISO 13485:2016 by reference. FDA also transitioned to its updated medical-device inspection process from that date.

This means FDA strategy should consider the relationship between the submission, product development controls, manufacturing activities, and the organization's quality system.

For establishments involved in commercial distribution, FDA registration and device listing requirements may apply. Foreign manufacturers also have U.S. Agent requirements, while importer responsibilities depend on the establishment's role.

Elexes can support:

⦿ Establishment registration and listing assessment

⦿ U.S. Agent coordination where applicable

⦿ Manufacturer/importer role assessment

⦿ QMS readiness considerations

⦿ Submission-to-QMS alignment

⦿ FDA inspection readiness

FDA Regulatory Support After Submission and Market Entry

FDA interaction does not necessarily end when a submission is filed.

During review, FDA may request additional information or clarification. For example, the 510(k) review process can involve interactive review and formal Additional Information requests.

Elexes can support:

⦿ FDA correspondence and interaction

⦿ Responses to FDA questions

⦿ Additional-information responses

⦿ Regulatory position development

⦿ Submission amendments where applicable

⦿ Change-impact assessments

⦿ Post-clearance or post-approval regulatory strategy

⦿ Registration and listing maintenance

⦿ Post-market regulatory obligations

If there is any modification of design, materials, manufacturing process, software, labelling, or intended use for any marketed devices, then such modifications may need regulatory review.

FDA provides certain guidance regarding what kinds of modifications require a new 510(k).

Post-market responsibilities can also include Medical Device Reporting and, where applicable, corrections and removals.

Common FDA Regulatory Challenges

A submission route selected before classification, intended use, claims, and predicate analysis are adequately understood can create downstream rework.

Even though a predicate appears technically identical, it needs to be carefully evaluated from the viewpoint of intended use and technical characteristics.

Testing plans are more useful when they are connected to the device's regulatory pathway, risks, claims, and FDA expectations.

Existing EU, Canadian, Australian, or other market documentation can provide useful source material, but it should not automatically be assumed to satisfy FDA requirements.

Generally, the FDA guidance provides the thinking and recommendations of the agency unless there is any legal or regulatory requirement applicable. Elexes segregates the regulations, FDA guidance, recognized standard and device specific requirements while preparing the regulatory strategy.
